Although they may pay regular taxes, taxpayers who qualify for such deductions or incentives may become zero-tax companies or pay marginal taxes.  The government also depends on the steady and continuous flow of taxes, one of the primary sources of income, to pay for various costs related to the welfare of the country.  Thus, the idea of \u200b\u200bminimum tax was introduced to ensure that the intention behind introducing such incentives\/deductions was not completely diluted by indirectly removing and imposing zero tax\/marginal tax on such companies. The AMT rate is 18.5%.  (plus applicable surcharge and cess).  The AMT rate is 9% if the person is located in an International Financial Services Center (IFSC) and receives income only in convertible foreign currency.<\/p>\n<p>In a fiscal year where the tax on ordinary income is less than the AMT, the AMT is the tax charged on &#8220;adjusted total income&#8221;.  The AMT must therefore be paid by taxpayers to whom the AMT rules apply, regardless of regular tax.<\/p>\n<\/p>\n<h2><strong>AMT in Income Tax: Applicability<\/strong><\/h2>\n<p>The idea of \u200b\u200bminimum tax was initially introduced for corporations and gradually extended to non-corporate taxpayers.  AMT was first introduced <span style=\"color: #0000ff;\">Limited Liability Partnership (LLP)<\/span> by the Finance Act of 2011, and the present provisions were replaced by the Finance Act of 2012.  Accordingly, the following taxpayers are subject to the AMT provisions:<\/p>\n<ul>\n<li>All taxpayers who are not corporations, as well as taxpayers who have claimed a deduction under the section &#8216;Deduction with respect to certain income&#8217; of Chapter VI A.  These deductions are allowed under sections 80H to 80RRB and are applicable on profits and gains of certain industries including hotel industry, small scale industrial undertakings, housing projects, export businesses, infrastructure development etc.  However, for this purpose, section 80P deduction as applicable to co-operative societies is not allowed.<\/li>\n<li>to deduct under <span style=\"color: #0000ff;\">Section 35AD<\/span>100% capital expenditure incurred for specified businesses, such as operation of a cold chain facility or production of fertiliser, is eligible for deduction. Additionally, note that the AMT provisions apply only if the normal tax payable in a given financial year is less than the AMT.<\/p>\n<\/p>\n<h2><strong>AMT in Income Tax: Exempted from applicability <\/strong><\/h2>\n<p>a person, <span style=\"color: #0000ff;\">Hindu Undivided Family (HUF)<\/span>Association of Persons (AOP), Body of Individuals (BOI), and artificial juridical persons whose adjusted total income does not exceed Rs.20,00,000 are exempted from the application of AMT provisions.  Since LLPs, partnership firms and other non-corporate assessees do not come under corporations, they are not covered by this exemption based on the monetary limit of adjusted total income.<\/p>\n<\/p>\n<h2><strong>AMT in Income Tax: AMT Credit<\/strong><\/h2>\n<p>Although the AMT was implemented to deduct taxes from businesses that pay no taxes, it also aims to ensure a steady stream of taxes for the public exchequer.  Therefore, while a minimum tax is levied in a financial year where the normal tax is less than the AMT, the AMT paid in the earlier financial year is carried forward to the greater extent of the difference between the normal tax and the AMT in subsequent financial years. and is allowed to be reduced against standard tax.
