After Parliament passed the central version of the Real Estate (Regulation and Development) Act 2016, states including Haryana started enacting their own version of the real estate law-HERERA, keeping in mind the fundamentals laid down in the central version .<\/p>\n<p>The RERA Act Haryana or the Haryana Real Estate (Regulation and Development) Rules, 2017, came into force on July 28, 2017, while the HRERA portal was launched on October 4, 2018. Developers can also use this facility to register their project with HRERA.  Now, select the project authority whether RERA Gurgaon, RERA Panchkula or Haryana Real Estate Appellate Tribunal-Enter the captcha to search for projects under RERA Act Haryana. There are chances that you may fall in the trap of some suspicious person.  As a precautionary measure, you can access the list of registered agents on Haryana RERA website who comply with Haryana RERA rules.  There are 1,115 registered agents on the HRERA portal as of February, 2022.  Details about their district, registration certificate etc. are available online on RERA Haryana website. Before filing a complaint, make sure you read the Haryana RERA rules.<\/p>\n<\/p>\n<p><strong>step 1:<\/strong> Go to the homepage of RERA Haryana and select the option to register a complaint.<\/p>\n<p><strong>step 2:<\/strong> Fill the form on HRERA and follow all the steps as instructed.<\/p>\n<p><strong>step 3:<\/strong> Once you fill and submit the HRERA form, you will receive an online complaint number.  Keep it handy for future use.<\/p>\n<p><strong>step 4:<\/strong> Make the payment on the website of RERA Haryana.  At present there is a fee of Rs 1000 per complaint.  An additional cost of Rs 10 per attachment is also levied.  The payment can be made through Demand Draft in favor of Haryana Real Estate Regulatory Authority.<\/p>\n<p><strong>Step 5:<\/strong> After HRERA payment, print the acknowledgment page for reference.<\/p>\n<p><strong>Step 6:<\/strong> You will also need to take a print out of Performa B on the HRERA portal.  This will be a detailed form. Once you are sure about the details entered, submit the information.  A temporary project ID will be saved.<\/p>\n<p><strong>Step 6:<\/strong> Keep a few copies of this HRERA registration form handy.  Of these, three will be handed over to the Authority.<\/p>\n<p><strong>Step 7:<\/strong> All necessary documents like bank draft, license, approval, renewal letter, ownership document, bilateral agreement with DTCP, copy of LC-IV, wherever required, power of attorney, zoning plan, building approval and such other documents as mentioned on Haryana Have it ready. PAN card, address proof, photograph, contact details, details of registration, bye-laws etc. are required to complete the online registration.<\/p>\n<p><strong><em>See also: all about <span style=\"color: #0000ff;\">Stamp Duty in Haryana <\/span><\/em><\/strong><\/p>\n<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Haryana_RERA_Latest_developments\"\/><strong>Haryana RERA: Latest Developments<\/strong><span class=\"ez-toc-section-end\"\/><\/h2>\n<p><em>Update April 28, 2021:<\/em><\/p>\n<h3><span class=\"ez-toc-section\" id=\"Property_sales_on_the_basis_of_super_area_shall_be_null_and_void_Haryana_RERA\"\/><strong>Sale of property based on super area to be null and void: Haryana RERA<\/strong><span class=\"ez-toc-section-end\"\/><\/h3>\n<p>The Real Estate Regulatory Authority (HARERA) in Haryana has ruled on April 27, 2021 that if a property is sold on the basis of super area, it will be treated as an &#8216;unfair\/fraudulent&#8217; trade practice.  Promoter.  The transportation work to be done for a project should also be done on the basis of carpet area only.  Haryana RERA&#8217;s move comes after several complaints from home buyers that developers are selling properties at super area rates and not carpet area rates.  This rule will apply to all real estate projects, whether registered or yet to be registered or exempted from registration.<\/p>\n<p>&#8220;No transfer deed of a real estate unit shall be registered, except on the basis of carpet area. In cases where the real estate unit was allotted to the allottee before the coming into force of the Act, the promoter, at the time of registration of the transfer deed , will disclose all the components that make up the super area. However, the conveyance deed will be registered only on the basis of carpet area,&#8221; said Herrera.<\/p>\n<p>This means that for ongoing projects, where units have been allotted to allottees on the basis of super area prior to the Real Estate (Regulation and Development) Act, 2016, the promoter shall disclose the components constituting the super area.  In case the conveyance deed has not been executed, the promoter has to mention the carpet area and what constitutes it, in addition to the super built-up area.  The objective is to protect allottees from being cheated when units are sold on the basis of super area.<\/p>\n<p>KK Khandelwal, president of HARERA (Gurugram), warned that punitive action would be initiated against promoters or real estate agents violating these directions.  He said that the practice of selling realty units on the basis of super area is not only vague, misleading, opaque and confusing but also leads to avoidable litigation.<\/p>\n<p>,<\/p>\n<p><strong>Resolution and Penalty:<\/strong> KK Khandelwal, chairman of Gurugram RERA, has said that the authority has so far been able to resolve 70% of all complaints i.e. 6,598 complaints.  So far around 509 penalty notices have been sent and a fine of Rs 40 crore has been imposed on the defaulting developers.<\/p>\n<p><strong>Brokers under investigation:<\/strong> Strict action can be taken against brokers who are registered but not licensed.  Going forward, the Speaker has said that their registrations may be cancelled.
